Recourse if any?

Hello everyone, I acquired a fly river turtle last Tuesday November 26th. I took him to the vet as I am very fastidious when it comes to my animals health (particularly ones that are new arrivals and that I don’t know what normal is for them). I did wait for six days to allow the animal to settle in and because I didn’t know what normal was for these guys. Long story short, seller refuses to cover any vet costs (spent over 500 dollars to treat a fungal infection vet assures me was a pre existing condition prior to receiving the animal) despite the seller having a health guarantee upon arrival. Seller initially replied saying that they would have done a betadine scrub and a saltwater bath. Then they claim I should have returned the animal so they could have taken it to their vet. I understand I am out the money at this point and while my ultimate concern is the health of the animal I would like to warn others of this so they won’t have to go through the same thing. At this point seller refuses to mark animal as sold leaving me no way to dispute the transaction with morphmarket. What if any are my options?

Others will come along with more experience with this than me but here is my 2 cents worth.

If this animal was wild caught there is always more of a health risk than those captive bred or even captive born, The fact that you waited 6 days to take the animal to the vet works against you even though the vet determined the infection was a pre existing condition.

The fact that the seller has not marked the animal as sold is troubling unless the picture is just a representation because there are others? Of course I am sure you would already know this.

This is a very unfortunate situation and I am not sure you have much recourse other than giving an honest review about the seller.

But you will hear from others with advice.

I am sorry to hear all of this!

To get straight to the gritty part, you are outside of MorphMarkets Default Store Policy timelines (which is 4 hours from delivery).

While frustrating, sellers are not responsible or liable for any vet costs once in the buyers hands.

I would take them up on this offer if it is still an option, for a 100% refund.

You can use the “+” icon on the message thread on MM to leave a rating.

I am wondering what this seller is telling people when they inquire to buy an animal that it is already sold? Wouldn’t that be against MM regulation? I found 2 sellers with a turtle such as this listed as available?

OP never said what the animal’s current status was set as. It may be listed as “on hold”, not still for sale.

That said, it is listed in the MorphMarket rules that ads must marked “on hold” and “sold” in a timely manner.

I must be misunderstanding but I take it that the animal is still listed. I only found 2 sellers with this type of animal and both say “for sale” and when you do an inquire to buy both animals show still available on both of the sellers stores.

So I apologize if I have gotten this incorrect???

This.
I mark mine as on hold until I can verify that the animal has arrived safe and is okay. Then I mark them as sold.
Hold animals won’t show up in searches for available animals for sale. You specifically have to search for on hold for that.

@caron Correct or not is irrelevant, OP has already been advised to contact support over their issues with the seller so that they can evaluate and handle the situation. You’ve also missed that there are three sellers, one of whom has a multi-animal listing. If that seller is the one in question, the ad would still be up as there would be remaining animals available.

While not relevant, the animal was sold to me as the last one. The item has not been marked sold. I am theorizing her, but until the animal is sold I can not rate the seller (not too worried about that) but morphmarket treats it as if there is no transaction between the two of us. With no transaction there is nothing for morphmarket to review or contest.

So what’s not relevant? I do believe that it’s very relevant considering it was sold to you as the last one…….if that’s what the seller indicated to you……

Have you tried using the “rate this” option available when you press + in the messenger window as directed? If that does not work, contact support and they can help you with rating the seller, as well as note down your concerns.

Unfortunately they wouldn’t be contesting anything, anyways, as you’ve already been told you’re outside the statute of limitations to file a dispute. This is why it is incredibly important to familiarize yourself with MorphMarket’s rules and default store policy before purchasing anything.

Sellers have a duty to do their best to properly represent their animals, but it is also the responsibility of the buyer to make sure you know as much as possible to protect yourself and your purchases.

I’d also note for the future, if you were not previously aware, the animal you purchased was one that was not captive bred, but captive born/hatched and then imported. These animals are far more likely to come with parasitic or fungal infections as they have not been raised in heavily controlled conditions, and these issues may not always be immediately apparent.
